1. Introduction
Welcome to Midket. These Terms & Conditions (“Terms”) govern your use of midket.com and services provided by Midket. By using our site or placing an order you agree to these Terms.

2. Who we are
Midket is a Nigerian-based gifting service that helps customers in Nigeria buy and send gifts to recipients abroad. We purchase items, arrange packaging and coordinate delivery to international addresses. We are not a shipping carrier.

3. Services

• You select products from the site, make payment, and provide recipient details.

• We arrange purchase and international delivery on your behalf.

• Where necessary we use third-party sellers, payment processors, and delivery partners.

4. Orders

• Placing an order constitutes an offer to purchase the selected item(s). We may accept or reject orders.

• Order confirmations are sent by email; a confirmation is not a guarantee of acceptance until we process payment and supplier availability is verified.

• You must provide full and accurate recipient details, including correct name, address, phone number, and any customs information required.

5. Pricing & payment

• Prices shown include Midket service fees but may not include customs duties, local taxes or import charges — these are the recipient’s responsibility unless otherwise stated.

• Payment must be completed at checkout. We accept the payment methods displayed on the site. Payment processing is handled by third-party payment processors; Midket never stores your card details.

• If payment fails, we will notify you and may cancel the order.

6. Cancellations & changes

• If you cancel before we purchase the item, we will issue a full refund minus any non-recoverable transaction fees.

• Once we have purchased the item or the supplier has accepted the order, cancellations may not be possible; refunds will depend on supplier and carrier policies.

• Requests to change recipient details should be sent immediately to support; changes may not be possible after dispatch.

7. Delivery & customs

• Delivery times are estimates. Midket is not responsible for delays caused by customs inspections, local carrier delays, strikes, natural events, or incorrect recipient details.

• Customs, import duties, and taxes vary by destination and are out of Midket’s control. The recipient may be required to pay these to receive the package.

8. Returns & refunds

• Returns are subject to the supplier’s and carrier’s return policies. If a supplier accepts return, refunds will be processed per that policy.

• Refund eligibility will be assessed case-by-case. Evidence may be required (photos, proof of delivery failure). Processing refunds may take up to 14 business days after approval.

9. Liability & disclaimers

• Midket acts as an intermediary and assumes responsibility to exercise reasonable care when purchasing and dispatching goods.

• To the fullest extent permitted by law, Midket’s liability for any loss or damage arising from our services is limited to the value of the order plus any shipping/handling fees paid to Midket.

• We are not liable for indirect, consequential, or punitive damages, or for delays/losses caused by customs, carriers, or third-party suppliers.

10. Prohibited items

• You may not request Midket to purchase or send illegal, hazardous, restricted, or customs-prohibited items. If a prohibited item is detected, we may cancel the order and refund according to supplier/carrier rules. You are responsible for knowing local restrictions.

11. Intellectual property
All site content, trademarks and logos are the property of Midket or its licensors. You may not reproduce or use site content without permission.

12. Privacy
Your data is processed under our Privacy Policy which forms part of these Terms.

13. Indemnity
You agree to indemnify and hold Midket harmless from any claims, losses, liabilities, damages, and expenses arising from your breach of these Terms, misuse of the service, or violation of law.

14. Governing law & disputes
These Terms are governed by the laws of Nigeria. Disputes will first be attempted to be resolved by mediation; if unresolved, disputes may be referred to courts of competent jurisdiction in Nigeria.

15. Changes to Terms
We may update these Terms. Substantial changes will be posted with a new effective date. Continued use of the site after changes indicates acceptance.
